Can H1-B visa holder invest in a business
I have two questions, My husband is a H1-B visa holder, is it possible for him to invest in a business or are there any restrictions? second, if he invests money in lets say buying a gas station would it be possible for him to hire his wife on H1-B?
Any information would be appreciated.

Thanks for your reply, I do appreciate it. You are right, one does not need a degree to run a gas station that was just an hypothetical idea. The main idea is to open an ethnic (Indian cuisine) restaurant and he would be hiring me as a chef and would apply for my H1-B......is this a feasible proposition or would there be objections from the labor department?

It depends, but ethnic chef indeed is a profession that often could
support a successful visa application.
Do note that for an H-1B, you absolutely need a degree, and also the job
must require your degree. I don't know the restaurant business, so this
might just be a prejudice, but it seems to me that you'd be more likely to
be successful in a larger, upscale restaurant than in a low-end fast-food
type of restaurant.
Also, if the owner is your husband, it will be essentially impossible for
you to get a Green Card through the business.

A classmate of mine who entered here on F-1 - has with a Bachelor
degree in Business Adminstration from his country - got H-1 through
when his brother in law who owned a gas station hired him to do some
adminstrative work. They were doing that so that they could pay tax
to their government and be exempt from mandatory serving in military
bcak home.
