Hi,

I've heard that Canadian citizens can't apply for H1B visa since they are
entitled to NAFTA TN1 visa? Is that so?

Thanks,. Al

They are different beasts.

My wife and I are both Canadian residing in the US. She is on an H1-B which is a 6
year VISA. I am on a TN-1 permit, which is a one year temporary work permit.

The original poster was "sort of" right. A Canadian can't get an H1B *visa* but they
can get an H1B status. Canadians do not require a visa no matter what status they
want to enter in.

Actually, for some status, Canadians do require a passport visa, also if they have
abused previous status, they may have to get a visa. But in general for most status,
Canadians do not need passport visas.

Specifically, E (Investor Trader) class visas.

H1B visa or status I can't speak for the difference between either one. What I can
say is that I'm on a TN1 and a friend in the same company who started on a TN1 is now
on an H1B working towards his greencard...it cost the company a few K to get him on
that H1B I think.

Mathew I guess you are right, I just heard of a Canadian citizen working for Boeing
who worked their for a year with TN-1 and then the company helped him to get his H1B,
he too, is working towards his green card

A visa is a permit to enter the country (in this case the US). An H1B visa is a
permit to enter the US on H1B status. A Canadian generally doesn't require a visa.

As for a Canadian having H1B status it is quite common and often used as a stepping
stone on the route to a Greencard.
