E2 is often the only way rather than best way, and it certainly never goes well with move.

Have you got kids who are coming, too?
Have you already got a marketing business?
Have you run a business before?
How much were you thinking of investing?
How many people do you intend to employ?

If you've already got a running UK company, look at setting up a US office and xfering yourself over on an L1.

If you've got $500k lying about, look at buying a green card with an EB5.

If you want to move to the US with kids, E2 should be bottom of the list, some would say off the list.

You don't want to rush the visa stage. Look at all your options before making your choice. A bad decision on a visa can haunt you for a very long time.

Longer the better. If you formed it last week, it probably ain't gonna to fly. If it's been running a decade, that looks a lot better. But it also depends how it's been running....if all but the last month it's been an empty shell, that ain't gonna fly, either!

I hate to recommend any lawyer.....it goes against the grain! However, yours is increasingly looking like a case that requires an experienced one to give you some idea whether it will go or not.

ailalawyer.com is somewhere to search. Don't be afraid to interview them before you let them have your case. You need proven experience in L1s out of London for marginal businesses -- ask for examples of successful cases they've already done that are similar to yours. Check their bar standing and AILA membership. The last rule is that if they guarantee anything, it's time to run!
