Background Checks!
Comrades,
I have some questions hopefully the experienced might know the answer to.
I have recently acquired my H1B status, (converted from F1, MS in CS), and now I plan to visit India next year January 2004 for my bro’s wedding. If I leave the country (US), then I would need a new H1 visa stamped on my passport to return. And now, since I was born in Kuwait (sic!), the immigration personnel are asking me to undergo a background check (new rule supposedly), which they say might take 3-4 months (up to 7 in a case) to complete. How the h*** am I supposed to stay outside this country for that long?? My company won’t allow that by any means. Now I ask all you people who were/are in a similar situation:
Is there *any* provision by which we can acquire the visa stamp here itself? Or do I necessarily *have* to leave the country for the same? (Does one need to go their home country?)
Has anyone undergone these background checks in the past year or so and what could be the appx. time frame in a city like Bombay (or similar)?
I request anyone (anyone anyone), if they have any information regarding this issue, please do write your suggestions.

In theory, you can try and get your visa renewed through St. Louis. In
practice, though, they typically deny it if you are subject to the
security checks (and I agree, being from Kuwait, it is virtually
guaranteed that you are.) Similarly, other consulates will tell you to go
to the one in Kuwait.
What you can try and do is contact the consulate in Kuwait and see if they
are willing to start the background check before your arrival. Early in
the process, consulates would sometimes accommodate such requests,
although I hear that they usually no longer do that.
Also, unfortunately, the 3-4 months seem to be more wishful thinking,
anything less than six months seems to be close to a miracle right now.
The second thing I can recommend is that you contact your Congressperson.
I don't think he can help you, but at least it will keep him aware that
these background checks are unacceptably slow.
Realistically, I am afraid that right now, it is not a good idea for you
to attend your brother's wedding.

Somebody else posted here a while who was a British citizen, just happened
to be born somewhere in the middle east.

In theory, you can try and get your visa renewed through St. Louis. In

Hi,
if I were you, I would forget about teh wedding. I have been waiting
for a non-immigrant visa due to security check for over 8 months now,
after being in the US thousands of times.
It's just NOT worth it. These checks are taking A VERY LONG TIME!!!!!
no answers, just waiting........
And beleive me, it's no fun.
But it's up to you of course.

You really have been in the US thousands of times? wow, must have
millions of frequent flyer miles then. If we all exagerate how can we
differentiate good advice from bad, truth from fiction
I am sorry about the long wait times, I am sure lot's of innocent
people are being unfairly treated. However, how many innocent people
were at WTC on 9/11, maybe if people from countries on the list
started talking about the lack of democracy in them, condemming hatred
and terrorism openly as opposed to letting their silence shield the
terrorists then getting a visa to US would be easy and simple.
