Well exactly but in that case it's impossible to really prove you won't stay in the us, but she seemed to think because I had the opportunity too, on the k1 visa but didn't stay, shows that I don't want to live there so that it could work in my favour.

This is absolutely true, insofar as it's philosophically impossible to prove a negative!

I understand her reasoning, convoluted though it might be - but I disagree with doing so for the simple reason that you don't want to give the officer any ammunition that would make him question your current intent - and, for the record, that's all that actually matters... your current intent. You don't want to open that door for him. If he finds it, well... good for him - but don't give him the key and invite him to scrutinize your past more than might otherwise be the case.

A bit frustrated because I don't think the lawyer necerssarily then gave the correct advise. Because she said everything is based on the fact I then went for a k1 visa.
Also on another note I have been employed at the same job for a year, but I am also self employed, she said it's good to state I have this self employment thing on the side as it even more shows my ties, I thought that could be more of a negative?
Look, in many ways, the process is a crap shoot. I can instruct you how to play the game, but that will not be a guarantee of winning. Just the nature of the beast.

While on the gaming metaphor, if you don't bet you can't win.
