B1B2 overstay by few 6 days - anyone experience reentry into USA recently Jan/03?
I have a B1B2 multiple visa. Due to a situation beyond my control - I
was unable to leave the USA before the expiry date of the 6-month stay
stamped on my I-94 departure record. (Small portion of the I-94
attached to my passport)
Therefore I have now overstayed for 5 days. I will leave the USA by
air to Europe in the next 3 or 4 days ( I'm just waiting for a
confirmed reseravation )
I intend to re-enter the USA after a short holiday in Europe.
1)My question is - does anyone have any experience very recently
(Jan/03)regarding re-entering the USA? What questions were asked by
immigration upon arrival at the airport?
2)Was the Immigration at arrival aware that one has overstayed ( by
only a few days )on their last B1B2 visa?
If so - what did the immigration ask/do?

You can file form I539 :
http://www.ins.gov/graphics/formsfee/forms/i-539.htm and explain very
precisely why you respected conditions on page 4 (right side) with any
document that can support your say. It would have been much better to file
it before the end of your status. If you file now and it's denied or if you
don't file it, you can face a 1 year ban and won't be able to enter in the
US before Jan. 2004. If your application is approved, you'll be in status
and everything will be ok. If you would have file this form before the end
of your status, you would have been in status (you would only have been out
of status when you would have recieved a letter stating that your
application was denied ; INS is slow enought, I assume it takes at least 1
mounth).

I really have to go to London. My multiple B1B2 6-month stay will be
over by about 10 days by the time I leave to London. I will stay in
London for 2 or 3 days and then return to the US on the same multiple
entry B1B2 visa. Will I have a problem with immigration when I
arrive?
I would like to hear from anybody who has had experience very
recently.

You may well have a problem when you try to get back. 2 reasons.
1) you went out of status and generally the ins dont care how long you overstayed and will not look kindly apon it. When you go to the airport to leave you will hand in your I-94 for the airline to send to the INS. The INs then match up your arrival slip with your departure slip and will see you overstayed.
2)it looks like you have been here for 6 months so when you come in again they will see that you were here for 6 months ask why your coming back ..YOu will have to show them evidence of funds,. a flight out of US and any other info you have regarding your ties to your home country.
Basically you should try get yourself back in status before leaving by sending in the appropriate form with the reason you overstayed.
The immigration officer at the airport has every right to deny you entry so be wise.
