B-2 Visa Extension When Wife has Green Card. Help please
I entered the US with my wife and 7 yr old son. My wife (a nurse) and
son have Green Cards, this was disclosed and I was given a 6 months B2
visa which expires very soon. I did not apply for a green card
originally because I do not wish or need to work in the US. My wife
does not plan to stay permanently in the US rather this is an
opportunity to have a working holiday, (she worked in New York on a H1
visa for 18 months in 1993/4 and I visited for 6 months then), and a
chance to explore "donor egg" programs which are unavailable in
Australia and have another child. We found a program and are scheduled
to start in early June. If a pregnacy results my wife would like to
give birth in the US as after 4 miscarrages flying is risky.Naturally
I would like to be with my wife during all this then soon after the
birth we would all return to Australia. If we are unsuccessful I would
like to be able to stay till the end of 04 as my wife would find
working (to pay for the program) and our sons school hours a difficult
juggle on her own and we want to disrupt his education as little as
possible by having a year of school in the US before returning to
Australia where unlike here the school year starts at the end of
January. I fear that the INS will view my wanting to stay longer as
evidence to settle when my wife has a green card. Do we have any
options, any advice would be greatly appreciated

I would indeed share your concerns. If I was in your shoes, I would
probably apply for a GC of my own, based on hers (assuming that she got
her GC after you were married, that likely is possible) rather than trying
to extend the B-2.
