Attending School when H1 to F1 Application Pending
Hi Everybody:
I had a quick and would be grateful if the experts could give their
comments/suggestions:
Can I start taking the classes when my petition to transfer H1 to F1 is pending for
approval ? I understand that I cannot work on campus or draw any stipend when the
petition is still pending.

immediately effective that say that you now have to wait until approval before

immediately effective that say that you now have to wait until approval before
you can start studying.

Wasn't that rule applicable only for the B1/B2 to F1 and NOT to H1-F1 ? Would be
grateful if the experts could clarify on the above.

This is no longer true. F1 MUST now be approved before admittance to University.
Say, you have H1B and is working, you filed for F1 and quit your job.
Before F1 is approved, you are not allowed to start taking classes, as you already lost your H1B status which allows you to take classes.
Somebody correct me if I am wrong.

I volunteer to correct you ;-)
This rule only applies to B visitors (tourists and business visitors). All
others can still start studying while the F-1 is pending.
In fact, an H-1B can study without ever filing an F-1, as long as he
doesn't quit his job.
