asking for advance parole timeline II
what is the deadline to ask for an AP that is "possibly usable"?
My wife has 30 days left before she has overstayed 180 days....
If I file for AOS tomorrow...does that stop the clock from ticking?
At what point does the clock stop ticking with respect to overstay....?

Filing for AOS will stop the clock. The key date is when the office accepts
the application. So long as that is within the 180 days, she should be able
to use AP.

as i am not cheeky enough to apply for a fee waiver for AP (will pay for that myself when I can)
do i need to file and pay for that fee along with the rest of the forms for AOS?
or can I wait "x" amount of time to file for AP because some clock has stopped based on the fact that I have filed for AP
I think that filing AOS with a fee waiver request and filing for AP at the same time will cause denial of fee waiver on all forms because I was able to pay for "something"

I just talked to BCIS and they told me that I could ask for and receive a fee waiver on advanced parole to...and if the fee waiver for advance parole was denied, then that denial would not cause denial of fee waiver for I-485 I-130 I-765
Upon talking to them, they also made it seem as if the clock does not stop after applying for AOS
I am tempted to apply for fee waiver for I-131 as well now....I could base it on the premise of emergency travel....
what do you think?

I think you're playing games, and with only 30 days left before your wife crosses the 180 overstay mark you're playing loose with her well-being. Not my idea of being a good, reliable husband.

oh shut up Jeff....before you give us your concept of a reliable husband realize that I have a settler's visa for the UK...get your facts straight before you insult anyone...if we get barred we will live out there
