arrived J1 H3 denied apply H1B can I stay in usa?
Hi there I arrived on a J1 visa and before it expired I applied for an H3 visa. This was denied after 11 months waiting! and I have now applied for an H1B, I have a sponsor, but do I have to leave the country? My I94 was stamped D/S.
My attorney says I'm not in a visa status, but I am worried if I leave I will not back in, can I not get any temp visa while I wait?
Any help would be grateful.
