Applicant for Canadian PR needs F1 visa, Urgent!

Default Applicant for Canadian PR needs F1 visa, Urgent!

Hi,

I’m a Chinese, and have been in Canada for almost two years on
visitor visa. We have submitted application for Canadian permanent
residents, and have received the initial assessment with interview
waiver. Now I need a US F1 visa to pursue a graduate study in US. And
I’ll apply it in US embassy in Toronto, Canada. My questions:

1) Since I have to prove my TIE with my home country, i.e. China, is
it convincing to the embassy since I have applied for Canadian
permanent resident, which is an obvious proof of “immigration
tendency”?
2) Does it make sense that I just need prove my TIE to Canadian since
we have received the initial assessment?
3) What’s your suggestion to me in this case, i.e., To what
country, my home country China, or Canada, the country to which
I’ve submitted the immigration application?

Any insights and perspectives will be greatly appreciated. Thanks in
advance.

Tricky question. Since you are saying "we" I assume that you are talking
about your spouse or domestic partner. This should usually be sufficient
evidence of ties to your home country. Note that your home country is your
country of residence, not necessarily your country of citizenship. So for
your purposes, Canada can well be considered your home country. Actually,
the US really is just interested in whether or not you are likely to
leave. If you were able to show strong ties to, say, Mexico or Kenya, that
would be just as good (just more difficult to prove!)

However, having emigrated once, and then from a very foreign culture to
one that is very similar to the US, does make it likely that you are a
flexible person who easily adjusts to different cultures. That could be
considered a factor in evaluating immigration intent.

On the plus side, you already have an established home in a wealthy
country with little emigration pressure.

Yes, that is probably better in your case.

your case will be judged solely on the perspective of the visa officer who interviews you for the F1. he/she could accept your permanent residency application as sufficient proof that you do not wish to over stay your visa in the US. strictly speaking you should be proving your ties to china but since you're in the process of immigrating to canada, you might just get away with showing your ties there.

Hi,

Thank you very much for your kind and insightful response, which
really help clear matters considerably. By WE in my former post, I
mean My husband and I. My husband now works in Canada and he is the
principal applicant for Canadian permanent resident. He will not
accompany me to US, so he, together with our obligation to satisfy
the residency time as prospective PR, will be my ties to my present
residency country, say, Canada. Is my taking of your perspetives
right?

My gratitude to your generosity goes beyond words!

taking into consideration that your husband will not be accompanying you to the US - you have a stronger case. i think you should be fine as you can show that your husband is working in canada and you are also in the process of immigrating to canada, hence chances are that you will not take up permanent residence in the US. please make sure you explain your case as clearly and concisely to the visa officer because the ultimate decision relies on his/her perception of your case. good luck!
