Default All LC Processing On Hold

It seems that DOL has put all LC processing on hold. There is absolutely no change in
progressing times since beginning of 2002.

Yes! That seems to be true. Even INS is pondering to stop H1B program.

INS cannot stop the H-1B program because it is written into the law. And I have not
heard of any serious suggestions of abolishing it, either from INS or from Congress
(although a few individual Congresspeople do suggest it occasionally, and have for
many years).

All right, I actually called the Connecticut Alien Labor Certification department. As
I wrote in a previous article, their RIR processing date has been stuck on June 16th
for several months. Here's what they said, or at least how I understood them:

Before this winter everything was going slowly but moving along. They have 2 people
working on RIR applications, so surely they had some backlog, but at least the
processing dates were advancing, as was reflected on the website. At some point (this
winter?) there was a surge in RIR applications (RIR conversions?) - they received
several thousands in one day with processing date BEFORE the one they were working on
at that point (June 16th 2001). I think this was due to RIR conversion, but I am not
sure. So, now they have to clean those cases up first, then return to the original
"line". Right now they are still cleaning up that extra pile with a processing date
somewhere in April 2001. Once they do it, and return to the original ones, the
processing date on the website will start moving again.

I suggested that they put an explanation to that effect on the website, because I am
sure that they are getting lots and lots of angry calls they have to deal with
(instead of processing the cases), and the lady said that "she'll pass it along to
the person responsible for the web content".

He was reporting ONLY on Connecticut LC department. What about all other service
centers. There is NO progress in any service centers.

True. What he described, though, would be make sense if all other offices were
affected the same way. After all, if CT was suddenly swamped with thousands of
applications in a single day, it stands to reason that this would be a nationwide
phenomenon. Of course, it depends on what the reason for the surge was.

I now recall that they used the word "amnesty". Do you know anything about it?

Anyway, I think that the most important thing here is that they *didn't* say anything
to the effect that "we got an order from INS to hold all processing for an indefinite
amount of time".

Hope that CT and all other DoLs will get through these extra cases and get back to
the original line soon.

I see! That would indeed explain it. The "amnesty" that she must have been referring
to wasn't an amnesty at all, but rather the extension of the 245(i). People who were
out of status had to file their Labor Certification before a certain date in order to
get it. And, yes, this would indeed affect all offices.
