Advice from an attorney please!
I have posted before about my daughter and her boyfriend who was in the US illegally. Well, he has left the US and gone back to Mexico, because his father passed away. He left the US at 18 and 9 months of age.
What I would like to know is since he entered as a minor without inspection will he be subject to a ban from the US if my daughter filed for the fiance visa? Would it be better if they married in Mexico? What would she file then? Is there anyway way he would qualify for a waiver? What is the best thing for them to do?
I would appreciate help.
