Achieving Legal Permanent Resident Status

I have been in the USA from the beginning of December but I am here LEGALLY. I came in on
a visa waiver at the end of November. The waiver is valid for 3 months.
Can I take advantage of the new 245 bill or would I have had to have been here ILLEGALLY
to qualify? I am quite prepared to stay in the USA and not return home if this would
eventually give me permanent resident status here.

Paul,
If you are here on the visa waiver program, you can not take advantage of 245(i). In
addition, you can not change your status while in the U.S. If you have plans to live and
work in the U.S., you will have to first go back to your home country.
