About my EB-1 case

Default About my EB-1 case

Hello. I'd like to have some opinion on my current situation. Here is
my story:

In June 2002 I started my EB-1 petition (as extraordinary artist), in
May 2003 the California Immigration Service requested additional
evidence (RFE). I and my attorney provided all the requested evidence,
then in August 2003 the Immigration Service denied my application
without considering all the submitted material. After the denial, we
filed a request to reopen or reconsider the case and a few days ago the
AAO (Administrative Appeals Office) ordered to the Immigration Service
to reconsider my petition withdrawing the denial, so now my case is
returned back to the California Immigration Service... well, my
questions are:

1 - How long do you think will take the final decision?

2 - How much do you think will be the chances to be reconsidered
successfully?

Any opinion and speculation on this matter is very welcome.

I really don't know. Your attorney will probably have more information
than I do. My guess is that they will expedite it a bit, so it should
hopefully be faster than petitions filed right now.

That depends entirely on your case. But since AAO already decided in your
favor (which is a relatively rare event), my guess is that your odds are
pretty good.

Thnak you Ingo for your kind reply.

Of course, I already asked to my attorney how long could take this last
procedure but she is not sure, she think around 1-3 months. I posted my
question here just to know if anyone had my same experience in the
past.

About my chances, I really hope to have the approval and I agree with
you: I heard about a lot of people had no chances at the AAO office.
The fact, in my case, was that the Immigration Service officer was so
sloppy and contradictory with my petition that AAO withdrew the denial
without hesitation...
