Default ? About Driving

Okay here's the thing. Dan has a conditional green card and we are applying for
removal of conditions in January. Recently he took a job as a landscaper with a
business in town. During the job he has to drive a dump truck which is in
disrepair. The thing has holes in the floor covered by pieces of linoluem and there
is no current inspection sticker on the truck. We are concerned that the truck might
not be legal to drive. How will this affect Dan's status if he is stopped and
checked out by the police? Will we be in trouble with INS???

Why would you want to have an unsafe illegal truck out on the roads anyway? Why not
get the truck up to specs to be safe. I have no idea what would happen to your
husband if he is pulled over, but I am concerned about an unsafe truck being out on
the road. Would it not be safe than to be sorry, as the saying goes?

The trouble will be mostly for the company but also for the driver, possibly by the
police, but also possibly from the Department of Transportation if he is driving it
around town. They can stop him and do a check of when the truck last had it's annual
safety expection. He should really refuse to drive until it can pass expection and
gets a sticker. It won't have any affect with INS.

The ramifications are many and all of them serious. INS might well think adversely if the following scenario occurs:

1. Dan is driving an unsafe, uninspected vehicle. He loses control of the truck, hits another vehicle and/or a pedistrian and someone dies. As driver of the vehicle he can be charged with vehicle manslaughter and if found guilt go to prison for it. He can be sued for damages. Why? Because he is the driver and as such it is HIS RESPONSIBILITY to see that the vehicle he is driving is safe drive and has been inspected as per the state regulations.

While the company is responsible ultimately for providing State approved vehicles to their employees and they will be held accountable by the authorities, Dan also has a responsibility to see that any vehicle he drives meets State's requirements for safety and inspection.

I know that jobs are hard to come by in some areas of the country but please have him think twice before accepting a position where not only his life, but the life of an innocent might be in jepordy.
