Abandoning I-485 process
I wish to abandon my I-485 Process. I have left the US but at the time
of leaving I had a valid AP and the AP is valid till April 2004. My
EAD / H1 both have expired.
I have the following questions:
1. Can I enter the US just based on AP ? If so how do I explain it to
the officer ?
2. I may need to travel to US again in the future for business. I want
to keep my record clean by abandoning the I-485 process ? What are the
forms that one needs to fill out ? How does the process go along ?
What is the proof that I need to keep that I have abandoned the
process , etc ?
3. In future, if I have to visit the US for business reasons, the best
option for me is the Business Visa ? Right ? Would any issues be
caused at the consulate ? This is assuming that I have abandoned my
I-485 process, etc correctly.
Thanks in Advance.

Re: Abandoning I-485 process
You didn't state any reasons for your decision abandoning AOS (I-485)
process. If it was just from your will, you can change that and get
back to US before your current AP is expired. You are entitled to have
benefit (the right to apply/renew EAD). What might happen at the
border is beyond me. If just playing according to the book, they have
to let you in, so you can wait for the final verdict on your case.
If you decide take no actions and complete abandoning the current
process, you may or maynot have admisssion problems in the future
depend upon your citizenship. If you are from the countries which are
required to have a visa coming to US. You have to disclose that you
had immigration visa application before. Convincing officers you don't
have the same intent could be a challenging task. But if you from
those countries people zipping in and out US relative freely, you have
less things to worry about as long as you have no troubles with the
law and your name not on any terriosts or drug dealers watch lists.
