******URGENT***** F1 to H1B, out of Status for 2 months??

Default ******URGENT***** F1 to H1B, out of Status for 2 months??

Hello guys, I'm on F1-OPT right now. I've not graduated still and took
pre-graduation OPT. I've applied for my H1B in April this year and my
H1B starts from Oct 1, 2007. The problem is that I need to pay my fees
for the this FALL semester and be in status till October. And I don't
have any money to pay the fees. If I don't pay, I will become illegal,
right? What is the option to be legal and still continue with my H1
from October without paying this fees? Can someone help me? Thanks.

Leave the USA at the end of your OPT, get an H-1B visa, re-enter the
USA using the H-1B visa shortly before you start work as an H-1B.

I'm not an attorney, please confirm with other people on this board,
but as far as I know
you can stay up to 60 days after expiration of your OPT. You can't
work during this period though.
Just another option...

I'm still on F1 and it is pre-graduation OPT. Does it still follow
same rules?

Just to clarify:

When are you planning to graduate? Or is it your intention to drop out of your program and start working? As far as I know, the 60 day grace period only kicks in after official graduation.

When does your fall semester officially begin? Is it just a question of avoiding your school reporting you on SEVIS as having dropped out before Oct 1st?

As JJ says, it may be that your only option is to leave, and come back with your H-1b.

No, I'm not sure; I think you may be entitled to 60 days grace after the completion of a semester. When is the official end of your OPT? When were you last in school?

There is a 60 grace period after graduation if you did not file for OPT to leave the US. Also there is another 60 day grace period to leave the US after the completion of OPT.

So they are two 60 days grace periods. Sounds to me like you are dumping your graduate studies to begin H1B. You want your cake and have it at the same time? Your best option is to leave the US and re-enter as H1B this way you will avoid any mishaps with H1B crossing F1. Because my dear you will have a lot of questions to answer because if you fall out of status on F1 it could very well hurt your H1 status. So withdraw completely from your F1 status go out of the country and reenter as H1.
