I would think that you are in a better position finding sponsorship whilst in Australia that if you go back to the UK. I suggest you consult a migration agent as I understand that DIAC can be kind on the 28 days thing. Then put all your efforts into getting a new sponsor, even if its a job you don't fancy long term. Then, if you are able to gain PR on your own merits, make the application. At least that way you will be in employment while your visa is processing.

Hope you manage to sort it out and stay.

I would also add to the above, that I believe a new employer can "take over" your 457 visa. I am not sure how this works in practice, but I mention it because it would probably be an easier sell to a potential employer i.e. you tell them they would "just" be taking over a visa rather than applying for a brand new one from scratch.

I trust you are looking into the legalities of your employer's actions? The same employment laws apply to you as they do everyone else regardless of what type of visa you have.

Unfortunately not - a new employer would sponsor you on a new 457.

Syedney, I hope things work out for you - as far as I remember, the 28 days only starts once DIAC formally notify you of their intention to cancel your visa, but I'd use this time to contact a migration agent and discuss any options you have. DIAC can also extend the time period to leave the country, but what circumstances this comes under I have no idea.

Not since 14th September 2009. Only the nomination part of the process needs to be repeated. As I mentioned, I don't know the ins and outs of this but I have also seen some posts from people who have transferred their visa to a new employer. It might help Sydeney persuade somebody to take him on if they think there is less paperwork and waiting around.

On this note, I saw George Lombard and he has confirmed that I can just get any new employer to take over my visa. No need to repeat the whole visa application process...What a relief!! :thumbsup:

Oops, apologies :D That's bloody typical though, OH changed jobs on his 457 last July and it was a whole new process, its about right they'd change it after that!

Least we're PR now and don't have to worry about such things.

Thanks everyone, the interview went really well.

The CTO who interviewed us (4 of us at the same time!) said to me he thought we were the best bunch he has seen so far!! :thumbup:

However, out of last 12 ppl they've seen, they only chose 2...:eek:
