OT: change of status NOA date question
Hi. Does anyone know the answer to this question? My nephew just applied for
a change of status from visitor to F1 student. His I-94 date has an expiration
date on it, and the Fed Ex delivered his petition to the service center before
that expiration date. We have that receipt. USCIS signed for it. His notice
of action, however , is dated one day after the expiration of his I-94. They
didn't bounce the petition back. They cashed the check and gave it a case
number. Does anyone know if they will say that his petition was too late? Or
was the important date the one of the receipt of the fed ex? We had no control
over the day they date the NOA, only the date they would receive it. Thanks.
