Lost I-94

Default Lost I-94

My friend is adjusting status (marriage with USC).
He lost his I-94 and intends on filing the I-102 (form to replace I-94).

Question is: does he file the entire AOS packet along with the I-102?
or

does he first file I-102. Once he has the I-94 in hand, does he then files for AOS?

He needs to file a copy of the I-94 along with the AOS package. So if he doesn't have a copy of the actual I-94, I would say he'd have to wait for it first.

Note to others...always make a photocopy of any important immigration document in your possession and keep the copy in a safe place.

One immigration attorney, who even occasionally posts to this group, insists that a copy of the I-102 filing is ok to submit as a substitute for the replacement I-94. Since the I-102 can take a long time to be processed, that makes sense to me, but I've never looked into the details of what is allowed.

I've never really seen it discussed in detail in this group (tho a search isn't a bad idea)--you might want to look further afield for an answer to this.

Thanks for the replies folks.

From what I understood on the directions to the I-102, he can file for replacement of the I-94 in conjunction with his AOS packet, rather than waiting to get a replacement (which can take a long time) then filing for AOS. It's just that it was a bit confusing on the form. On one place it reads that filing for replacement can be done in conjuction with AOS if one never received an I-94 at POE.

In another place it reads differently. I will do more research on this. I would assume that this is a situation that occurs more often than not. But apparently, everyone is very careful with their immigration documents (aside from my friend).

I was in a similar situation. I lost my I-94 but knew what the number was. I filed a I-102 to obtain a replacement. I filed the AOS with a copy of the I-102 NOA receipt and entered the I-94 number on the I-485. The I-102 was denied because INS (at that time) checked their records and could not verify my arrival. So, at the AOS interview I told the IO I lost the I-94 when I was asked for it. The IO was satisfied with that and didn't mention the I-102. Filing the I-102 might work for your friend. Good luck to him.

I am in the same boat as yours

I have already sent in my I-102 forms. I guess I will wait for the receipt then mail all my AOS package to Chicago.

I talked the the Lawyer and USCIS officer. ( they all me that the new I-94 would take 4 - 6 months also I NEED TO HAVE I-94 record in order to files the AOS package)

I guess I will take my chance . once i received the I-102 receipt. I will mail my AOS

Hi All

Responding to this post based on personal experience, I too had lost my I-94but was informed at the time of AOS that I had to have a copy of my I-94 prior to filing. I was informed this by numerous people at USCIS aswell as a local attorney. I had to wait approx 4months to get it back and approved as I had to do a RFE. USCIS couldnt seem to understand my various name changes so I had to write a letter with explanation and once received they approved my application for the I-102. Please keep in mind I applied for AOS 20months ago so my response is out of date. Hope this can help you in your application. Best of luck
