I have debts in the Uk too. I haven't been able to work here for the last two years. My concern is and it may sound silly but can you be arrested for non payment of debts if you return for a holiday. I'm applying for my EAD after my I 360 was approved. I have student loans and a couple of credit cards which I still need to pay off

Hi hazeleyes - Don't worry about it, I went back for a holiday in March and didn't have any problems.

but I still owe the Uk goverment family allowance (which I didn't realise I couldnt get but cancelled 2 1/2 yrs ago) and family tax credit. I'm really scared and want to pay it back but until I work I just can't. The family tax credit stopped whilst I was in the Uk but they told me they had overpaid me whilst I was there and need repaying.

Perhaps call the citizen's advice bureau and ask about returning for holidays. I don't know what rules apply when you owe the government money.

Ok well I bit the bullet and just phoned the SLC to whom I owe a lot (they too are a government body).

Almost had a panic attack ( I have them since I was abused by my ex) had a glass of Jack and coke first.

Apparently they never received my deferral notice last year but are sending out another for this year. The interest I owe is over 2000 pounds.

The good news is they said I could pay 10 pounds a months towards the interest debt. All they needed too, as I can't work, is a letter from my boyfriend to say he he gives me less than 2000 pounds a month so that I can continue to defer my loan. He actually gives about 500 pounds for my rent and phone.

Well tomorrow I guess I'll try and speak to the other benefits people.

I'm with you on this one, the banks are just a set of greedy ba******.

They write off millions each year in bad debt, after all they can afford to:frown:

You need to calm down a little....don't simply run around and call everyone advertising your home as more as most likely everybody will simply add a ton of interest to your debt and you'll be far worse of than ever, your life will be hell....just go home, live your life, speak to credit counselling when the time is right and write up letters asking interest free time to pay if and when needed.....I promise you, with what I went through with my sister has been an eye opener...

I'm not actually going home to live but I was just wondering what the consequences would be if I went back for a visit.

Thanks for the advice -yes I do need to calm down. Waiting 2 years for my abuse petition to be approved has been a nightmare in itself.

None, you'll be fine, well you wont will you, as you'll be thinking about it during the flight and sweaty buckets through customs - but all for nothing, you'll be fine.

The credit card debt will disapear within the next fives years as gonzo...The Child tax will probably not go away, but thats such a mess in the UK anyways that no doubt that will change and maybe if your lucky that will disapear

Thanks for your thoughts-feeling somewhat less worried.

I do actually intend to pay these debts back but haven't been able to since my EAD was cancelled nearly 2 yrs ago due my AOS being denied. Hopefully now I have a VAWA approval I can start getting back on track with the priority being paying back the child benefit and tax credit first

It must be so difficult moving across the world alone without the added worry of paying back 7.5K you didn't realise that you owed.

If the OP can buy a bit of time, get settled first and then sort this out when financially able to, then at least it's one less worry for the time being.

If she contacts these people immediately and gives them her new address then surely they are going to start hassling her for payments which will stress her out even more.

I agree, if you dont give them your USA address, you can use it as a credit ref, most Uk banks accept credit refs from the USA as its the same equifax etc. We spoke to them about it for a mortgage when we go back (we dont have bad credit there, but still no recent credit)
Maybe tell them the situation and that you will be in touch when you are set up with an income. Contact them when YOU are ready to.

Thats interesting what you say about Equifax and Experian. Does the same apply for Australia? If we can use our good credit rating here when we return surely that would mean easier access to credit etc?
