Default help

Hi everyone,

Well, me and my girlfriend are planning on getting married pretty soon and I want to apply to adjust my status, but I know very little about all this.
I came to the US about seven years ago with my parents as tourists and decided to permanently stay. The visa was issued for five years so it already expired and I was wondering if that would be a problem when I decide to apply?

It may or it may not. Overstays can be forgiven by USCIS when the applicant is married to a USC. Just don't leave the USA before getting your green card in hand.

The forms required are listed on www.uscis.gov, under "how do I adjust status to permanent resident?"

You might want to have a 1-time consultation with an immigration attorney who can point you in the right direction, too, especially regarding your lengthy overstay.

Does your girlfriend realize what she's getting herself into? What is her status in the US? From what you've written, you've been out of status for at least two years which means that if you leave the US for any reason whatsoever, you'll automatically incur a 10 year ban. How have you been supporting yourself? You couldn't have been working legally since you currently have no status in the US. Does your g/f make over 125% of the current poverty guideline... she'll need that or she'll need a joint sponsor. How does she feel about supporting you until such time as you get a legal job?

her status in the US? From what you've written, you've been out of
status for at least two years which means that if you leave the US for
any reason whatsoever, you'll automatically incur a 10 year ban. How
have you been supporting yourself? You couldn't have been working

over 125% of the current poverty guideline... she'll need that or she'll
need a joint sponsor. How does she feel about supporting you until such

So if I'm working illegally, it doesn't count as income?.

Yes, either that or have a joint sponsor who does meet the financial requirements.

Yes she would have to cover you an if anyone else lived in the house
would have to include them aswell......Have you not read the
paperwork????????

Luis, especially as you've "just" turned 18, there are different rules you might want to find out about--I think you may have some remedies available to you because of your age.
You and your girlfriend have a quite unusual situation, and you should really look up a place like Catholic Charities (or other immigrant assistance group---usually low or no cost) and see about getting some more specific information.

I'm smelling a rat here, or it may just be me, but if your just turning 18 now, and you cane here 7 years ago.... was it just you that stayed or the whole family?!
