Default have Contract need LC and Green Card processing

Hi,
I have a contract for software development with very large company. I
have been with this company on contract for the past 4 yrs and I am on
H1-B

My current contracting company has been doing my labor certification.

As with most contracting companies.. they have become more greedy and
things are not working out. I would like to get new contracting
company.

So I would like to transfer my contract to a new company. The contract
is for about $70/Hr or $140,000/Yr

This is what I need:

1. Get H1-B transffered

2. I would like the new company to provide a pre-processed labor that
can be transffered to me. Or if your comapny is located in New
Hampshire, Wyoming, South Dakota or Montana pls contact me. These
states have been selected because the labor certifications in these
states is current.

3. Apply for my I-140 and I-485

In return I would be willing to give 20% to the contracting company or
$28K+/Yr

Greencard processing fees and H1-B paid by contracting comapany
Also I donot expect Medical insurance, 401K or any other such
benefits.

That won't work. They will have to file a new LC specifically for you.
Transferring an LC from an old employer to a new one, or from one employee
to another, is supposed to be theoretically possible but in practice
virtually never works.

Also, it doesn't matter where the company is located; what counts is where
you would be physically working.

I don't think that this would be legal, either. What you could do, though,
is to offer to work for them for $112,000 instead of $140,000, as long as
the prevailing wage is lower than $112k. As a side benefit, this would be
better in terms of taxes.

Remember that both an H-1B and a Green Card requires that you get the same
benefits as Americans would. So you may not be able to avoid this.

Sylvia is right.

If i were a company and got a LC certified -- i could place the position up on ebay for the highest bidder, and then hire that person and get them a gc. Which of course would never fly legally.
