Default What a Spanish visa for the case – a UK ltd, a French contract and work in Spain

Hi guys, my situation looks quite tricky. Hope someone out there could shed some light.

I run a UK Ltd company. My Ltd company signed a contract with a French company to work on a windfarm project in Spain. So, I need to go over there from UK to Spain to work on-site of the project. Basically, I need to work in Spain for the French company.

My Ltd company will be paid by the French company, and no financial links with any Spanish company. I get paid by my UK ltd company.

In this case, the regular work permit/visadoes not applicable because no Spanish employer is involved

I would be grateful if someone out there could offer some advice on the applicable types of Spanish visa/permit and how to apply for it. Really appreciate it.

So you are contracting for a French company to work in Spain.
If so then the French company needs to do the work for the permits unless it's in the contract that you do this.
My situation was different whereby I worked for the UK arm of an Italian company on various installations in Europe and worldwide.
It was always down to Italy to get the visa's and the UK company provided proof of where I paid tax, proof of health insurance and any other insurance or operating licenses (fork truck etc)
It's not that complex and I'm sure it's not the first time the French company will have done this.

If want to work in ES as non-EU national, you need work permit. Simple as that.
Who pays you or who you work for is irrelevant.

Either you take paperwork to ES consulate and apply for permit or your employed do it.

In this case it should be the French company as the visa office will want to see the contracts as the OP will be working for them (even as a contractor) they are ultimately responsible for them.
I would expect the Spanish Consulate would turn the OP away as the contract is between two EU companies regarding a Non EU citizen and the responsibility for that worker is on the major employer, which again would be the French company.
It desnt matter where the worker comes from, his or her status (employed, contract or even the owner of a company) work visa's are arranged by the employer not the employee for this. (same as in the long term one)

As an example to show how complex it is (and no its always been the same for short term contracts worldwide and the EU not just since Brexit.)
Although before Brexit all I did was pack my tools in my suitcase and go on 'holiday' to a nice factory and spend 12-14 hours a day there instead of on the beach.
You have always supposed to apply for a work visa even before Brexit if going to work in the EU, its just nobody ever did (except to companies like Coke who insist and always do, as I had to get one in 2017, 18 and 19 for installs in various factories here in Spain, Germany and Poland)
Further afield, I sat in immigration in Toronto for well over three hours once while multiple phone calls were made to determine if I could be allowed to enter. Even though the Canadian embassy in Rome had issued the work visa for me and were happy with the paperwork.
It all came down to the fact I did not have an introductory letter from the agent in Canada, to Italy requesting my visit. Even though there was one to the Uk arm of the company.

Thank you Barriej for the info. Interesting to know in your case Italy to get the visa for you. But in my case, the French company asked me to apply by myself, which has been a big problem. seems self-employed visa might suit my case, but it would take too long to apply and not guaranteed, so I stuck in the middle of nowhere...

Are you self employed/director of this UK LTD company.? Are you the sole employee?

You say the French company is paying the UK company, and then the UK company is paying you. Which sounds as though the French company has contracted with the UK company and you as an employee is going to do the work. The French company is not employing you.
In which case YOU need to get a visa of some sort in order to work in Spain. One can presume the French company contracted with you on the understanding your company/its employees could work in Spain in order to undertake the work.

None of the visas seem designed for this set of circumstances, you need an immigration advisor to help frame your application to the visa which has the best chance of succeeding.
