Hi all,

Was a member here years ago when I lived in the Caribbean and now back under my new persona as we are planning on emigrating to Spain from the UK in the coming years.

Do any of you have recommendations of a bonafide, non shadey, reliable firm of solicitors who take care of submissions of non-lucrative visas, property purchases and tax and pension advice?

Our position is that it is my husband and I moving out to join his sister and her husband who live there now, we will have a significant cash amount from the sale of our property here but will only be using a portion of it to buy a house out there - we have no need to go the Gold Visa route for a smallish place for just the 2 of us. My husband draws a pension (civil service) but no state pension as he's only in his 50's, and we are trying to find out the tax implications of not only his pension (and whether to do QROPS or not) but also having a large cash savings balance in the UK.. We will draw on those savings minimally each month and deposit an amount into our spanish account.

Well I can tell you for nothing that a civil service pension is taxed in the UK and has to be declared in Spain on your tax return The civil service pension is also of course totally safe index linked whereas anything that is based on investments etc is not

A thought - be careful you don't get caught for capital gains tax in Spain on your UK property sale - I think legal avoidance was all down to the timing of sale/entering the Spanish tax system - which has been covered in other threads. Pellicer&Heredia can advise...

yes I saw that, we're selling before we go and buy out there so safe in that respect

You have to sell in the spanish tax year before you move and move any other assets to cash.
Tax year here is 1st Jan 31st Dec.
So sell in 2022 move over sometime in 2023

There is no tax to pay on cash savings but if over €50,000 you have to declare in on the 720 form as well as any other assets over that amount.
