Please could anyone help me if you are on long term sick because of mental health issues how or can you claim your sickness benefit while living abroad in spain, any help would be appreciated .

There are certain aspects of DLA (Disability living allowance) which are transferable to Spain if you were receiving them before you moved here.
However when you move here you will no longer be a UK resident, and as such UK benefits such as housing, sickness etc are NOT claimable here. You will not be able to access the National Health Service at all as a Spanish resident unless you are a Pensioner or a dependent of a pensioner. You will be able to get a temporary state cover depending on your NI payments in the UK of late

Answer for UK benefit just takes two words 'You Can't', and for Spanish, you just won't qualify for any Spanish benefits.

As Concierge for the Spanish section of BE I would like to say hello and welcome.
BE is a very large expat website, so if you have problems finding your way around we have concierges who will try to direct you. The moderators for the Spanish forums are Mitzyboy and Fred James, moderators are there to ensure that the site runs smoothly within the rules of BE. Problems and complaints should always be addressed to a moderador who will look into the matter and deal with it efficiently and fairly. Our members who post in the Spain Forums are friendly and helpful with a wealth of knowledge of the issues of living in Spain. At the top of the page you will find a quirkily named thread called Free Beer which is full of important and useful information. Hope you enjoy your time participating in the forums.
Please let me know if you need any further help.

Living in the UK - can claim UK benefits
Living in Spain - cannot claim UK benefits and subject to certain considerations cannot claim Spanish benefits (what few there are)
its simple, if you are living in Malaya, South Africa, Timbuktu - would you expect to receive UK benefits ??
So why expect them in Spain.? ?
The last I heard Spain was a member of the EU but not a region of the UK like England, Scotland, Wales or Northern Ireland.

Instead of asking on this forum you should be asking the office who have assessed you for whatever benefits you are provided with and gain their opinion.

Some part of DLA can be claimed as well. If you are in receipt of ESA SG you can also claim Child Allowance (if you have kids). If your partner works 18 hours or more you might be also entitled to Child Tax Credit.
If you are eligible for ESA Support Group you can apply for health cover (through the DWP Overseas) and you are treated as a Pensioner (paying 10% of prescription charges).
This is from my experience but you will have to check with DWP or read the information from http://ukinspain.fco.gov.uk/en/help-...ions-benefits/

If you are on ESA Support Group you should be able to receive your payments here in Spain. If you are in receipt of ESA Working Group I think you can claim for one year, then (as in the UK) you go onto Income Support. Income Support is not paid in Spain.

I thought you could only claim child benefit if your partner was still residing in the UK and working there

for example, after years of not receiving child benefit from the UK I started receiving it (I had no idea I could/would - they just started paying it) when I became eligible for the widow's benefit (or whatever it's called) until the children leave school
also as an aside to that I was sent S1s for myself & the children - so if I could afford to not work I would qualify for healthcare here under the reciprocal agreement
the actual total benefit doesn't even cover my autónomo payments - but it certainly takes the 'sting' out of it

child benefit from the UK is payable as an 'add on' in a way to some exportable benefits

I wasn't aware that any kind of sickness benefit was transportable - but I know there have been changes recently

extending this further.........
you can get unemployment benefit but only for 3 months and have to be registered with your local Spanish unemployment benefit office and meet their requirements for "clocking on" which is reported back to the UK.
this is generally to allow you an interim period for jobsearch within a European country.

I suppose moving to Spain may be deemed to be therapeutic for someone with mental health issues, but without knowing more it is difficult to say much, especially if there is a helper involved in this.
