Default Trade Description Act

Hi all,
Maybe this is the wrong place to post............
My daughter is off to Fuengirola this Thursday 9/april and staying in the Ronda4 Apartments. booked the hotel and flights last November. She will be with hubby and 4 children, my grand children. The Ronda4 has just emailed to inform us the Swimming Pool is closed till end of April!!!!
To say she upset is putting it mildly.
I know for a fact they started this work in January and the unbelievable thing is its still being advertised claiming it has 2 pools but NO where does it say they can not be used!
She has contacted Travel Republic via phone but to no avail...
Does any know what her options are? ie money back? upgrade with POOL!
Any help would be great.................

This has happened to me once.
But I was in Spain so I cancelled the booking when I arrived at the hotel and discovered the lack of a pool.
Simply moved on to another hotel.

However not so easy if booked as part of a package or from a distance.

So so frustrating...she is still trying to sort it but ..........its a case of we will ring back at 12.00/1.00/ etc with the same old sh-ite!
Apparently they have offered Fuengirola Beach........def not sea front!!!

is it an indoor pool?

if not, it's highly unlikely that they'd use it anyway - it's way too cold

Yes the children would get hypothermia in a hotel pool in April!

A lot of the hotels have the pools closed until May/June, not unusual at all

It's the same for hotel entertainment, children's clubs etc. Most will only operate in the summer season

It's Easter the kids are on holiday and have been playing in the outside unheated pool

Gib is always a little cooler than the CdS i.e. Fuengirola

Me thinks we have gone off subject!
I was making the point that the Hotel is advertising Swimming Pool facilities knowing full well it was closed!
My daughter used a holiday brochure to select a familyholiday with swimming pool which she has paid for, but 48hrs before we leave they inform us NO Swimming Pool ...I think this is wrong but where do we go from here time is running out . TRAVEL REPUBLIC have not returned one call!!! is there any legal path to take.

you could try asking for their complaints book - this can be done online

for a Spanish company that's a very serious matter & will often have the desired effect

however, if they supply it & your daughter completes it & goes through the full complaints procedure I have serious doubts that it would make any difference

your daughter may have wanted a pool, but there's pretty much no chance that they would have used it anyway, so the complaint would likely be considered frivolous

it would be worth a try though

When a holiday is booked with TR you do not have the same rights as if you were booking a package holiday. TR act as agents and even if you booked both your flights and accommodation with TR this is not treated as a package holiday. If either your flights or accommodation "fails" you will only receive a refund for that part. What ever complaints you make about TR about misrepresentation etc they will do nothing as they act as an "agent" for the accommodation provider.

Last year we had a holiday arranged for two weeks in Portugal. My parents were flying from the UK and were driving down to Portugal. We booked two apartments with TR twelve months before the arrival date but 5 days before departure we received an email informing us that the accommodation had been overbooked. TR offered us one large 2-bed apartment with an extra cot for the seven of us. We declined this and said that as we had booked over a year ago surely it should be last in, first out. Many emails later and we managed to get TR to reinstate the original booking for two separate apartments. But originally all they offered was reimbursement for the accommodation and not for the flights.

The logos on TR site include ABTA and ATOL and we complained to them but they are not interested as TR are not selling package holidays.

The trouble is TR are good value when compared to other travel agents. When we were in Portugal last year we had a look around where we might want to visit this year. We found one accommodation and after speaking at reception we were told the cost would be 1,800 euros but the TR site had the same accommodation for £800. Big difference. You just have to take the risk sometimes.

Morning all,
Thank you all for your comments. Travel Republic never rang back! So Day2 of the saga. She is back on phone today at 8.00 Money back to re-book a different hotel is what she is requesting. When I said the pool was closed I failed to mention the whole area is closed ie Patio area with sunbeds and play park.................so its strictly room only! and they still advertise as per a normal day!
"Ronda4" shame on you.
