Taxable allowances

Hi all,
I have two children to have a taxable allowance against as well my wife. OK so far however one of the lads is my stepson and I do not have legal guardiaanship, but he lives at our address, is on my padron and al the school etc, has a residency card etc.
My company said today that he may not be allowable for tax rebates as he is not my legal guardian.
How do I stand here, is there a plan or do we have to suck it up.
Both my wife and stepson are Russian and we have had no problems thus far getting things sorted with all the social services and schools etc.
