Hi, can somebody please help?
Is it true that as an EU citizen (Australian) with a non EU wife, we can just rock up in Spain with no visa for the wife (as Australian), stay for up to 3 months and in that time apply for a redsidency card for the non EU spouse?
Or is there any paperwork needed from my home country?
Thank You

in answer to the question though an EU citizen can bring a non-EU spouse to Spain & apply for residence for the spouse
the EU citizen first has to register as resident, subject to the new proof of income & healthcare requirements

And his spouse then gets one of those lovely old residencia cards that we all want but cant have!

)no-one knows exactly yet what is required if you are only just arriving & not needing to work/working, although proof of pension & an S1 form works for pensioners , and working friends of mine have had to provide proof of work contract or autónomo - vida laboral
this is the current info from the British Consulate http://ukinspain.fco.gov.uk/en/help-.../residence-req

This forum is of course really on the ball and the subject has been covered at some length since the rules changes recently.
Have a look at this thread.

At the moment it is not clear just what the new conditions will be with regard to income but it is fair to say that you will be required to prove that you have sufficient private health insurance or are an EU pensioner on a reciprocal scheme.
Many of the local offices are refusing to process applications until these rules become clear. The new law was introduced in haste and the application of it clearly had not been thought through properly.

Funnily enough (or not) I was told I needed one when I was living in Menorca. Reason being was for the reduced rate in travel to and from the islands. The lady at the town hall looked surprised when I told her the rest of the country don't use them any more.
