The first case is obviously OK - it's your property and they can use the facilities - you wouldn't expect to ask the electricity company if they were allowed to turn a light on!

The second case -a Telefonica employee does not necessarily know the law - they are usually pretty wrong about most things!:) I certainly would not accept that as a definitive opinion!
