Right of access
Can anyone advise me on how to proceed? We are having "disputes" with a close neighbour - I won't go into details!! But basically they are making life hell. We have confirmed that to access their property, they have to traverse our land. There is no existing right of way and no drovers track that they can claim. There has been no formal agreement to alow this lodged with the notary or even been discussed. It has simply been assumed. I have been led to believe that we can deny (motor vehicle) access until an agreement is reached and financial compensation agreed??? There is alternative access available via an old drovers track but would require them to build access from it to their house.
I know any advice given is purely subjective and has no legal standing but I would appreciate hearing other opinions... It is a pity it has come to this but other options have failed and we're running out of options. We can't even move with this still lingering...
