Certain government pensions do not have to be declared. A retired police officer, for example, is exempt from declaring his pension even if it is over the threshold provided that it is his only source of income. The same may well apply to a teacher's pension but you will need to confirm this.

As for people who should be declaring and aren't, it may take a while but they will be caught up with sooner or later especially now that the Spanish treasury is looking for ways of making up the shortfall in taxes due to the reduction in CGT for non-residents from 35% to 18%!

In fact, many acquaintances who have not been declaring have recently received a letter from AEAT to the effect that they should be declaring for tax either as a resident or non-resident.
Thanks for your advice. As I say, I know of no other non-working expat who fills in a tax return. Our village is mainly Spanish, there are only a few expats; most of us live on capital or small pensions, none of us would be over the threshold for either wealth tax or income tax.

Now I have been told, we are going to have to submit a tax return. I'm going to be the 'mug' again, like I was when I actually took the trouble to pay a parking fine, other people have had them and just not paid them.

Sorry, I'm genuinely glad of the advice if that is the law - I just wish I hadn't asked.

Well two things .... Just because they don't do it doesn't mean its right, much the same as many Brits in Spain are not doing it right

And you won't feel that you are mug if in, say, 10 years time your neighbour comes to sell his house and is asked for proof.

My abogado said they would do our tax return for 80 euros ... If you go to a gestor I'm sure you will get it done for less, and one of my friends has it completed for 40 euros. Yours will be simple from what you say.

Does property in the UK have to be counted?

For income tax yes, if you are getting an income from it ... if its identifiable ... if you see what I mean.
For wealth tax, yes, but from what you said you won't reach the taxable level

Thanks again.

My son lives in the house with two lodgers but their rent goes to pay the bills/maintenance so I don't make any money out of it. Even the Inland Revenue in the Uk accept that!

The house is worth about £130,000 plus my Spanish property of around£100,000.

So I think I would be exempt on both.

Hubby already pays tax in UK on his pension.

Oh well, once more into the breach, dear friends!!
