Hi

we have a villa and private pool . We had the poo, constructed and it has been added to our escritura . A long story but about two years ago had a sale that fell through . We have now accepted another offer and buyers are using same solicitor that was was acting for our previous buyers . ( that did not go well and we were seriously out of pocket due to this solicitor ) a whole other story .
Anyway the sale only fell through as buyers sale in uk fell through . All paperwork was and is in order . Now this same solicitor is asking we provide a Certificate of use for the pool ,. I have never heard of this , i do not know any other person selling been asked for this and we have plenty of friends sold recently .
Anyone heard of it ?

On the escritura, how is the 'pool' described. It could be that it is described as a 'deposito' rather than a 'piscina'.

No as i said we had an architect do all the paperwork and its listed as a piscina not a deposito . :My main point is its same solicitor doing paperwork , no query a year ago pool been on paperwork 5 years plus .

I think these rules only apply to community pools or any that are accessible to the public. I have never heard of with a private pool.

i think so too , tbh i think Solicitor trying it on . I have replied there is no way i am wasting my time going to Ayuntamiento and asking for a permission to swim in our own poo. Lol .

Plus friends behind us sold and where never asked for any such thing .

Are you sure you are talking about the same things, or maybe he means the Antiquity Certificate?

The Antiquity Certificate is the document needed at the Notary to update the Title Deeds with any alterations introduced to the property, such as pools or extensions, done with or without a license. In the case of having done an extension or pool without a license, the Antiquity Certificate, frecuently known by the general public as “RETROSPECTIVE LICENCE”, is also very useful to guard against possible sanctions/fines, and to protect/state the legal situation of the property, in case the law would change.

In any case it’s highly recommended to avoid putting off potential buyers, due to the existence of undeclared buildings even if done with a license, to have your Antiquity Certficate ready. In the case that registration is not possible, the Antiquity Certificate serves to offer any potential buyer the maximum possible security against Townhall penalties.

Hi

no i do nit mean that . Actually i was highly annoyed at myself as we applied for the licence for the pool ourselves , had it built . Stupidly i didnt have it put on the deed and when we went to do this , despite the fact we had a lucence we still had to employ an architect and he did it on the Antiquity certificate .

i am not sure we are talking about the same thing lol

this link refers to the energy rating certifucate which is needed for a sale and yes we have that . Unless there us another section on poo,s which i can not see .

The best way i can explain it is , this " solicitor " if you can call her that is saying we need a licence to swim in our iwn pool?

The problem you have is that the buyers´ solicitor is working for them and not you!

Conveyancing lawyers seem to be quite lazy in general here and there is no standard conveyancing package that you would expect in the UK.

So yes from the sellers point of view it can be quite annoying when your buyers have a decent lawyer, but he is working to protect them, not you!

Perhaps the buyers of your friends place used the lazy lawyer suggested by the estate agent lol

You could ask him just to explain what it is he requires and why!

It could be that they want the first habitation certificate. We had a pool and terracing built up on our roof terrace, and even though we had it done with a licence and it's a pool and didn't extend the property at all, we still had to get the first occupation certificate which makes that two for our property.

Do you really want to loose a sale for want of a trip to your town hall?
