Hi can anyone advise if a doctor signs you off work( baja) what is the pay structure ?
My boss is saying day 0-3 I get zero pay ...and from day 4-20 I get 60% of my salary.
Is this right ??
Appreciate any thoughts or advice

According to this link about the law in Spain, your boss is correct

Seems to follow UK guidelines - nothing for first three days.

Sorry I have no idea. Not many people on this site have a Spanish work contract so not many will be able to help you

Surely what happens during the period of holday are the responsibility of the individual

I have seen people who have been in accidents or got flu whilst on holiday been credited with the whole period.
If you should become injured at work before a holiday then Yes, you should get credited with a pre-booked holiday. But if you can still hobble onto the Ryanscare flight to Magaluf then NO.
Sorry for the negative response but having had to cover for people who have been taken ill or injured whilst on holiday I have strong feelings on the subject.

If you took a day or more off after a Bank Holiday you also lost the holiday pay
When I took a day off to bury my father I lost the days pay

that is something that I found unacceptable in the UK - people becoming ill during a period of holiday and being "gifted" the holiday because of sickness.

I have a Spanish work contract. At the end of January I booked a short holiday but I took ill on the first day. I got a baja from el medico the next day. When I returned to work two weeks later, I asked HR about the situation regarding my holidays. They didn't know, but they consulted an expert in employment law, and yes, my holidays were credited to me to be taken at another time. It's a recent EU ruling: http://www.guardian.co.uk/money/2012...day-paid-leave. Oh, and I was also paid 100% during my time off work, but that is a benefit, not a right.

Yes I know I am very lucky to have a job, but sometimes it would nice for employers to show their appreciation, as they know those that have jobs are fortunate, but on the other hand they tend to take advantage.
