Default And now, the Spanish digital nomad visa

It's a shame the pound's just taken a battering.

Spain plans ‘digital nomad’ visa scheme to attract remote workers

The visas will be offered to people who work remotely for enterprises outside Spain and who derive a maximum of 20% of their income from Spanish firms.

As the law has yet to be passed there are still some details to be hammered out but it is expected that the visa – essentially a residency permit – will be initially valid for one year, renewable for up to five years depending on the applicant’s circumstances. Close relatives, such as a spouse or children, will be eligible to join the applicant.

Applicants must be from outside the European Economic Area and be able to demonstrate that they have been working remotely for at least a year. They must have a contract of employment or, if freelance, show that they have been regularly employed by a company outside Spain.

Given the conditions I can't see it being of much use to that many.

Not what many were hoping for either.

It really only works for those who are already working for a UK company ( or other 3rd country) who would be permitted to work outside of UK and also on a salary of 24.000 euros. You couldn't set yourself up as a remote working in uk in order to live in Spain. You would need to be trading for at least a year with proof of earnings before you could apply

Kind of Interesting. What does Spain think they will be getting from it?

That's what I was thinking and it's no substitute for what UK nationals had before ie EU freedom of movement.

My British neighbours missed the Brexit deadline due to completely unforeseen circumstances which they could do nothing to avoid. They used to spend six months in their house in Spain with their pet but that has been taken away from them against their will. They have a professional looking into various options for them and they had high hopes for the digital nomad scheme but it doesn't look very viable. What happens at the end of the five years?

I'm sure it's a good scheme for some people but it's not a long term solution to the loss of freedom of movement.

It looks like it's a solution if you've been working from home for a company since the pandemic and would want to continue to do so, but from Spain. This visa looks like it would be a better fit than than the self-employed visa is, but yes, it's not FoM.

Doesn't seem that onerous - 24,000 euros is only a tad above the UK minimum wage for anyone over 22 this year and it also doesn't seem too unreasonable to me to expect that the legitimacy and stability of the working arrangement can be proven.

You could certainly set yourself up in advance with a view to making the move later on, if you were keen on the idea.

It's really not much good unless you simply want a few years in Spain. If you get it you have to renew it every year - it is not an automatic 5 year visa. Also after 5 years you don't qualify for residency so you need to leave!. Not much good unless you are perhaps young and fancy a change for a while. In fact most people who meet the criteria would probably be better off getting a work visa as automino at least that way the get residency after the 5 years with SS contributions in place for pensions and the universal healthcare.

Autonomo has more expensive taxes and requires business plan, dealing with another country's paperwork from the beginning, etc...

Someone on the digital nomad visa could look for a job while there and switch across to working for a Spanish company when they feel like. It's easier to search once you're in the country.

Otherwise I assume they also have the option of re-applying for a digital nomad visa towards the end of their stay and continuing their residency that way.

As the proposed nomad visa wont give resident rights, getting a full time job here in Spain while on one of these will be impossible.
The applicant would still need to return to their home country and the employer would still have to prove that a non EU citizen could do the job and then apply for the employment visa...

I have an ex work colleague who has been looking at the terms for the nomad visa since it was announced and he has explored most of the proposed avenues, he wants to do help desk and customer issues here for the Canadian arm for our previous employer and then later transit to being full time here working with the Spanish arm.
He has already been refused a work visa because the job can be done by a correctly trained EU citizen.
He is looking at the Portuguese version at it appears to be flexible in its terms (but he still wants to end up in Spain at some point)

Plenty of people who are already ‘digital nomads’ in various parts of the world who would possibly jump at this. Clearly the Spanish authorities have put a few hurdles in the way to minimise abuse.

I'm not sure why people are so keen to say it doesn't give residency, the press release says it does.

Además, para atraer a los denominados nómadas digitales (emprendedores y teletrabajadores que se desplacen a territorio español) se establece un procedimiento más ágil para que obtengan el visado y la residencia, así como un régimen tributario especial.
And after five years of residency under that visa it seems you would be qualified to get long-term residency afterwards.

It has to be remote work ( online) and not one that effectively requires you to be present in person every so often . Financially the monthly requirement is around 2.000 euros. You cant earn more than 20% from a Spanish client. Finally- you have to be a university graduate which seems to suggest the position needs to be viewed as a skilled profession.

The new Nomad Visa scenario in Spain from the 1st of January 2023.
Possible Tax scenarios.
Live Questions and Answers.

New year, new visa

The Spain digital nomad visa will allow citizens of other countries to continue to work remotely and live abroad legally, so it has several advantages and is very interesting for those who wish to spend some time in other countries.
As it has not yet been approved, the exact duration is not known, but it is expected to last for one year and to be renewed for another two years if the requirements are maintained. So we are looking into 5 years.
