Hiya All
Been a while since ive been on here - but thought some of you guys might have some help or advice :O)
We moved over to Spain in July and rented a property for a wee while and obtained our padrons using the landladys escatura ( excuse my spelling). We purchased our own place in oct and have since moved into it. I am living here full time with the children so would be classed as resident - however my husband continues to travel to Aberdeen every 2/3 weeks and works on an oil rig. He contiinues to earn GBP and pay UK Taxes.
We have been debating whether i should go and obtain the residencia - however the bank advised us that we will be causing confusion as it will look like we are divorced as my husband would not apply for his residencia.
Ive been asking around for advise and whether it is obligatory that i do this and also what the benefits are.
I am aware that if we sell the property we have bought that it is in our interest to be resident to avoid high taxes. I have also been advised that the bank interest rates are more favourable to residents.
Anyone got anything they can offer ? Any other pros or cons before i go ahead?

Bank account rates for residents do carry (slightly) more favourable rates than those for non residents. There is a danger that your bank acct may be frozen if you are operating a non res acct when you are, in fact resident.
If you are living here full time then you really have no option by law but to get your residencia certificate.
CGT rates on property sales are now the same for non residents as for residents but if you sell as a non res then you have 3% withheld against your tax obligations.
As property owners in Spain you are also of course obliged to submit annual tax returns...whether you are non res or res and the tax implications are different. So you are going to have to come down on one side of the fence or another pretty soon!
