Hi Sam. Iknow numerous people who have had to get the Military check done. It can take numerous weeks I suggest you contact Annie. She lives in Ayamonte and is English but does loads of things like this.

Edit. Please do not quote personal phone numbers - use a PM. Fred

It's been in existence since late 1970s but only applied to non-EU nationals, which the British are now. Certain parts of Spain, including border areas are considered strategic and the military have to give permission for foreigners to buy or develop real estate. Best to get a local lawyer to do it for you. It can take a few months for permission to come through.

Not entirely:
'The order indicates that in those municipalities affected by the rule in which the land has been approved in a partial plan or is qualified as urban land, it will no longer be necessary to apply for a military permit. Only in those homes that are on undeveloped land will it be necessary for buyers to request this permit.'

Ah, I didn't know that detail, I just remembered the announcement and searched for a source to link to here but didn't read it through. My mistake.

Hola,
In my area I know my solicitor has had to get these permissions as a lot of housing here is illegal on campo land.
The company is Temple Cambria which you can Google - all solicitors speak English as do all staff

It's interesting to note that military checks are subject to EU membership of the citizen needing it, but not to NATO membership. The latter would make more sense.

Coastal demarcation

If you are considering purchasing a coastal property you should contact the Coastal Demarcation office in your region to get a certificate to certify that the property is not affected by the 1988 Coastal Law. Bear in mind that while it is possible to view the coastal boundaries of the public maritime areas online on the Environment Ministry’s website, this may not provide sufficiently accurate information on which to base a property purchase.

If non-Spanish EU citizens had to undergo the military check, it would be a case of an EU state discriminating against citizens from other EU states so it would end up in the ECJ.
