Income tax return 2015 (IRPF), loss to be considered, for Aymerich Golf Management S.L and Esuri River Golf Club, disappearance, as operatos of the Costa Esuri golf courses.

It is possible that some of you, bought in the past, the right of Utilization of both golf courses, which were in a beginning operator by Aymerich Golf Management S.L, and later for transmission with the rights and obligations to Esuri River Golf Club.

At the moment of the right of utilization acquisition, for a duration of 20 years (to each one depending on when really he acquired the right), we we all were thinking that it would last up to his end.

Unfortunately it has not been like that, and we must admit lost, but:

I understand that it is possible to diminish lost , to all those that at least do his income tax return in Spain (IRPF), since to the being a loss of right, this it can be compensated by the patrimonial earnings of the period.

In the income tax return (IRPF), in his paragraph of “Earnings and patrimonial Losses that do not derive from the transmission of wealth assets”, in spanish: “Ganancias y Perdidas patrimoniales que no derivan de la transmisión de elementos patrimoniales”.. (In the income tax return of 2014, it was the paragraph G1)
I Do not know today, which will be the number of the paragraph in the documents of 2015.
I recommend to all affected ones, must inform about this fact your auditor, ó your expert who should do the declaration of 2015.

En español, para que todos aprendamos idiomas.

Declaración de la renta 2015 (IRPF), y pérdida a considerar, por la desaparición de Aymerich Golf Management S.L, y Esuri River Golf Club, como explotadores de los campos de golf de Costa Esuri.

Es posible que algunos de Vds. compraran en el pasado, el derecho de Utilización de los dos campos de golf, que fueron en un principio explotados por Aymerich Golf Management S.L, y posteriormente por trasmisión con los derechos y obligaciones a Esuri River Golf Club.

En el momento de la adquisición del derecho de utilización, por una duración de 20 años (a cada uno en función de cuando realmente adquirió el derecho), todos pensábamos que duraría hasta su fin.

Desgraciadamente no ha sido así, y debemos de admitir esta perdida, pero:

Entiendo que se puede disminuir esta perdida, a todos aquellos que al menos hagan su declaración de la renta en España (IRPF), ya que al ser una perdida de un derecho, este puede ser compensado con las ganancias patrimoniales del periodo.

En la declaración de la renta (IRPF), en su apartado de “Ganancias y Perdidas patrimoniales que no derivan de la transmisión de elementos patrimoniales”. (En la declaración de la renta de 2014, era el apartado G1)
Desconozco al día de hoy, cual será el número del apartado en los documentos de 2015.

Recomiendo a todos los afectados, que informen de este hecho a su auditor, ó su experto que les haga la declaración de 2015.
