Default How do I get paid what is owed?

Hi there I like many other people of all countries have been ripped off by a supposed friend. She rented my villa out for the summer for me which I did to go someway to pay my mortgage but I have been left paying out more than I ever recieved from her. I am now trying to get the remaining money owed to me from her. I have asked her nicely and have now progressed to threatening to take the matter to a lawyer, all of which have been totally ignored.

Her so called company charged me for everything under the sun and more even though her website states the 30% charge made covers everything and no further charges will be made for advertising etc. She charged me (a friend) 35%, then charged me for advertising, garden maintenance and anything else she could think of ( I can really do without friends like her).

Anyway rant over. I really dont want to employ a lawyer to retrieve the outstanding monies as I feel she wil just ignore this too and I will end up paying out more than is actually owed.

What should I do?
Can I make a denuncia against her and her company?
How will that affect her?
What will it cost me?
How long should it take? ( spanish time?)

Any suggestions greatly received.

do you have a written contract in spanish?

if yes, and she has broken it..........

denuncia - free

probably won't have any immediate effect on her

court costs - who knows?


how long - again - who knows?

Unfortunately no contract either in spanish or english! Another thing my so called friend didnt get round to doing for me!!!!!!!!!!!

I have contemplated taking out an add in the local newspaper but knowing my luck I would probably just get denounced for telling the truth!!!!

If you had no contract then youve little chance of getting anything,I`d denounce her if its free just inconvenience her .

For revenge I`d proberley get 500 flyers printed saying what a con artist she is in several languages and pass them around the town where she operates!!Send her a copy first with the option of paying up.


This woould at least make me feel better

Thank you I really like that idea! I really do get fed up with people treating people badly and thinking it is their right to do so! I just want to feel like I am doing something!

That's interesting, I dont think she is at all legal!!! Her website states lots of promises none of which have been fulfilled! The only paperwork I have is the initial piece of paper she wrote which showed how much I could get, and the second piece of paper which she wrote down everything which had been deducted, and what was owed to me (after which she promised to pay the money into my bank account and I am still waiting). I only managed to get this after chasing around after her for 4 days while I was in Spain!

My mother then caught up with her again to ask why the money which had been promised had not been paid in only to be called a f****** c*** by her husband! Charming!!!

People really shouldnt be able to trade as a reputable company when they clearly not!!!!

Demand facturas (VAT invoices) which detail the amount paid, the IVA (VAT), her or her company's name / address / NIE (extranjero) or NIF (nacional) or CIF (certificado) numbers, plus your details including address and NIE numbers - for every euro spent.

If she can't / won't provide, you've really got something to denounce her over.

Out of curiosity which area is your property.

And surely if she has done this to you can you imagine what she must be doing to others and the trusting people that use her business for renting property from.

Happened to us some years ago and I have heard many similar stories. You can denounce but make sure you have been declaring the rental from your property. Best to send round the heavies, only language these people understand

I know its so bad. I really should have known better but thought she was helping me out! What a joke, she helped herself to a summers rental profit!!!!!

My villa is in Javea, Costa Blanca.
