I,ve been to the solicitor and she says to try writing to him asking for written consent which i,ve done and just posted  she said if he doesn,t agree to it that,s when we,ll have to go thru the solicitor. I,m just hoping a written consent from him will be enough for the spanish authorities when we get there! I tried getting in touch with the spanish consulate but didn,t get much help off them, they just sent me an email which appeared to be a standard email for people considering moving to spain and didn,t specificly answer my question

Do not be surprised if he says that he does not know what to write. If he does that then make sure you very carefully word a letter for him to sign.

Hope it all goes well

Hi oddities,
I,d already thought of that and have put in a letter worded how my solicitor had advised me to! All he has to do is sign it and put his contact details, surely that can,t be too hard for him to do ;)

Good for you. The reason that I said about it is because if they can find a way of being difficult they usually do just to spite the other person.

Hope this is all going to be easily achieved for you.

Re: HELP advice needed

I,m expecting him to be awkward about it like you say, just to spite me! I imagine he still holds a massive grudge because I moved to a different town with the children a year after we split simply for a better life (schooling, social issues etc) I was stuck in a flat with them in the middle of a not too nice city and wanted better for them, but i kept the door open for him to see the children when he wanted, what,s an hours drive to see your kids? Obviously too much for him! Thanks to all for their good wishes, will let you know if and when i get a reply from him.

I have spoken to someone who knows more than me about this, if he plays awkward then a day in the County Court will see you right, you can have his parental responsibility taken from him. For the good of the children and all that. If he wants to play silly buggers then go to Court. It's a hassle I know but, there's a good chance he'll have to pay the costs too if you apply for them. Even a threat of court action can sometimes make someone see sense, especially with his track record on maintenance etc

Good luck

I did actually mention in the letter that if he refuses to give permission then it will have to go through the courts so lets hope it does make him see sense! It could end up costing him a hell of a lot of money and all for nothing really because both my daughters have said that if he now decides he wants contact it,s too late because they want nothing to do with him, they don,t even remember him as they were only 3 and 2 yrs old when they last saw him.

Fantastic. I am so glad that you took advice from a solicitor and followed through with the letter. He has come up trumps for you whereas he cvould have been extremely difficult. Great when a plan comes together!!!!

Well done
