This situation is not unique it must affect frontier workers all over Europe and there must be some legislation to cover it.

Spain deny's Gibraltar is in Europe but insists that Gib obeys and complies with all European laws, especially the ones that benefit Spain or are costly for Gib to implement.

The above is probably the only example that differs from that policy, however due to the large numbers of Spanish voters it affects :o:o.

Gibraltar offers a very modern Hospital and a good healthservice to its residents.
Of the few services not available the Gib Government sends its citizens to Spain as private patients ( I believe the UK govrnment is involved in this arrangement ) or to the UK

That`s interesting, but I don`t think it has come up before on any of the previous threads on working in Gib and living in Spain

I think we are at crossed purposes here.

To become a resident you do NOT require proof of healthcare - you used to have to.

To get Spanish healthcare you need an E106 (or E121 if applicable).

I think what has happened by reviewing this part of the thread is that Fred J has informed us that healthcare is no longer required for residence.

From personal experience it definitely was a requirement. Therefore people who took up residence in the past had to prove healthcare and did so either by form E106 or by an insurance policy.

Now without this requirement people may be missing this important point

I thought most people knew that - the law changed on March 1st 2003.

OK, now im confused!!

a few more questions now:

if im living in spain and working in gib....

do i need a E106?
do i need a nie in spain

ive got all the forms, application for residance, application for nie and application for e106
all the forms are in spanish apart from the e106 one! erghhhh

There is no legal requirement for it now in Spain for residencia, but I think you will find it is needed in most others like Italy, France etc.
You can live in Spain without it, but a stupid decision not to have some sort of cover.

The fact that you will be working in Gib is not relevant at this stage.

You should apply to go on the Foreigners register as soon as you arrive in Spain and they will also issue you with an NIE number at the same time they issue the Certificate of Registration.

You should then sign on the Padron at your local town hall and ask for a padron certificate. You should apply to the DWP in Newcastle for your E106 and take that to the social security office (INSS) in Spain with your registration certificate and the padron certificate and they will register you for healthcare and issue you with a card.

Once you have been in Spain for more than 183 days in one calendar year you will be liable for Spanish tax but that means that you will not become tax resident until 2010 and tax is paid in arrears, your first tax bill will be due at the end of June 2011.

Working in Gib does not affect your situation at this stage. Your E106 will run out in 2 years, but from what Fredbargate has said, if you are working in Gib at that time they will give you another one.

I assume you will pay tax in Gib, but any that you do pay can be deducted from the Spanish tax due.
