First Occupation Licence

Default First Occupation Licence

We inherited a property and now want to get a rental licence. We need the first occupation licence. The property is in an urbanised area, has mains electric and is connected to the sewage system. We have been in contact with an architect who can sort everything out for us. She has told us that the local council will charge us over 1,700 euros plus tax to obtain the licence. This is on top of what the architect is charging. This seems totally wrong as whoever built it all those years ago didn´t get the correct licences and now we have to pay. Has anyone else experienced this and is this charge correct. The property has never had an occupation licence before. The property is almost 30 years old.

I think this does seem excessive but town halls seem to make their own rules so it is possible. Be interesting to see if anyone in your area posts a reply.

Surely you do NOT need a "FIRST occupation licence" but a "c'edula de habitabilidad de segunda o posteriores ocupaciones" (second or later licence of occupation".

It's normally a lot less than that - ask how they come to this figure.

Hi, this is what the architect is telling us. The property never had a first occupation licence when it was built. We are thinking about getting a second opinion from another architect. I must say we were very shocked at the amount.

Snikpoh is correct - I never had a cedula for my house and obtained a Segunda Ocupacion ((Alicante province) I paid 103,17€ (2016 price) plus architects costs.

We had exactly that in our Community, built in 2002, classic scenario builder then went broke. No licence. All services connected without it - not uncommon in Marbella area.We fought for several years but in the end agreed as a community we needed it , one of the reasons being some owners wanted to sell and it was impossible without it.
We applied for the licence and got it with a fine as the builder had not built exactly as planned and the area constructed was considered different to the actual planning permission plus there were some modifications requested by the Council that had not been done.

It cost us €60,000.-

Before doing anything I suggest you contact Temple Cambria solicitors in Conil who have the necessary local knowledge and will know what price you should be paying.

Thank you for the replies. I think we are going to call in at the town hall ourselves and find out what we need to do and how much it will cost.

Hi we called into urbanismo the other day. We were told the cost would be around 500 euros so someone got their sums wrong

We also want planning permission to build a couple of walls and a pool. We had no idea that you had to get permission in writing from the neighbours before they will give you permission.
