I have been following this recent topic as I have a problem with water leaking through a stairwell wall causing damage to my kitchen ceiling. My solicitor is currently preparing to sue the Developer(not MF), the Architect and builder who apparently all have liability. What is interesting from the posts is the suggestion that there will be 3 and 10 year insurances in place and that my claim would be covered under the 3 year policy. However, I am told by my solicitor that while the 10 year insurance is a legal requirement the 3 year one is simply a recomendation and in my case this insurance does not exist. I would be interested to hear if anyone has found this to be the case, or has any further comment.

However, it is only obliged to have insurance for damages that may result in the ten-year guarantee (garantÃa decenal).
They are responsible for all personnel involved in the building.
