THIS IS JUST A HEADS UP ON A WHISPER IN THE WIND.
THE OUTSTANDING EUC FEES FOR THE LAST THREE YEARS ARE TO BE PASSED TO A DEBT COLLECTION COMPANY.
THERE HAS BEEN NO REPORT BACK TO THE RESIDENTS ASSOCIATION BY THE COMMITTEE MEMBER WHO ALSO SITS ON THE EUC BOARD BUT NON THE LESS THIS WAS THE WHISPER THAT WAS REPORTED.
Sorry to be so vague but I do not see how we can garner information if we do not see minutes or get reports.

Mr. Paco Rubiño, president of the EUC and urban councilor (Deputy Mayor) will be touring Costa Esuri to verify the state of the maintenance of the development and then, at 17:30, will be holding a discussion with the residents of Costa Esuri at the Golf Club in order to set out the projects that the Town Hall have planned and also possible future services for Costa Esuri.
To demonstrate the interest and commitment of the Residents of Costa Esuri, a strong turn out at this meeting with Mr Rubiño is highly desirable and afterwards the monthly meeting of the Costa Esuri Residents Association will follow. This is a one off opportunity hear about the EUC and the proposals for future improvements and to join/attend the CERA meeting.

As for its functioning, the EUC functions by means of a Consejo Rector (Managing Board), within which the activities to be carried out are discussed and decided upon and then taken to the EUC’s General Assembly for approval.
The General Assembly is the EUC’s sovereign body. The Residents' Association has requested a legal opinion on who may vote on behalf of the Owners' Communities, which Mr. Rubiño expects to be issued shortly.
The EUC’s financial functioning is based on the quotas of the owners (the coefficient from the IBI tax bill). The total income collected is very low compared to the budget.
A new way to manage the collected quotas has been established for the rapid transfer of the income collected by Gestión Tributaria (Fiscal authorities) to the account of the EUC, which until now has usually been done every six months.
The management of the collected quotas is shown on the EUC’s budgets, and is shown on the accounts provided by the EUC, and is used:
a) For the maintenance of the gardens.
b) To pay for the services of the two attorneys who manage the administration.
c) To replacing cables and stolen and / or defective equipment.
Mr. Rubiño wants to clarify that the money that is collected by the EUC is used exclusively by the EUC for Costa Esuri. The members of the Board do not receive any remuneration.
Mr. Rubiño, as President of the EUC, has raised with the Consejo Rector the desirability of providing Budgets and Accounts that are clear and understandable for all the owners, and he also states his disposition to come to Costa Esuri whenever necessary to explain personally any question. He further suggested a similar meeting may be held every month or two.
In relation to the lack of information received by the residents, Mr. Rubiño would like to encourage the attendance of all the owners to the General Assemblies of the EUC, where it is possible to put forward any request and receive all necessary information.
With regard to the differences between EUC and IBI:
The EUC’s specific object is the maintenance and conservation of Costa Esuri. Taxes are a different concept. The IBI is a state tax relating to the property, independent of the fact that it is invested in the Municipality where it is collected.
Regarding the completion of the Urban Development Project, Mr. Rubiño explains that the execution of the outstanding works, according to the estimation of the Technical personnel of the Town hall, amount to 4,200,000 Euros. Martinsa-Fadesa gave bank guarantees for nearly 6,000,000 Euros. Because of disputes between the Town hall and Martinsa-Fadesa, guarantees amounting to approximately 4.5 Million Euros are retained within the judicial process. On the other hand, it is not possible to execute guarantees for an amount more than the cost of pending works.
The Town hall is studying different means to carry out these works, such as agreements with private companies and / or constitution of joint public/private companies.
A list of specific requests involving Costa Esuri has been delivered to Mr. Rubiño by the CERA.
I must make it clear that no minutes of the meeting have been issued by the board of the EUC and that these are contemporaneous notes taken at the meeting.

The date for the next EUC AGM has been set for the 30th March 2012. All owners are allowed to be present however only individual plot owners and inter-community President are allowed to vote. There will be a proxy system but we have no news on the rules for proxy votes yet more later. It has been suggested that the vote should extend to community Presidents and this may be the opportunity to extend the franchise so if you are in Esuri for Easter do get along to the Casa Grande on C/Huelva and make sure you voice is heard.

I thought I'd call up this thread since the AGM is on Friday, 30th March.
Any news about proxy votes?
Is it still the case that inter-communities have no vote (albeit they have a voice at the AGM) if they are in arrears of payment of the EUC fee? By that I mean one debtor amongst 100s. If that is true then only plot owners and Martin Fadesa can vote?
The minutes etc are on the EUC website.
