Cedula de Habitación that's the one that is not yet in place
I have been told that it has been apply for and told it will be about
7 weeks to come. After reading what's been written I will hold on
To the deposit until I have seen a solicitor next week just need to
To find one that's good with English.
Thanks so much for the good advice, I can see that this site will be a really good

Just looked this up because I'd never heard of it.
"En algunas comunidades autónomas la cédula de habitabilidad ha sido sustituida por la licencia urbanística municipal de primera ocupación".
I suppose this means it's the same thing by a different name.

Fingers crossed that the 'cedula' does actually arrive ... many properties on our urbanisation still do not have one, due to an ongoing dispute between the developer and the town council. However, surprisingly, some people still seem to have been able to sell their property on without this essential piece of paper

That's because, whilst you and I might consider it essential, many people don't - especially the Spanish (in my experience).

We have a property that doesn't have one - but then it's so old, it never has had one nor ever will!

They will tell you anything to get your money.
They told US that when we bought ours, and it took several years until it was sorted out because they hadnt even applied for planning permission correctly. Although we sorted it out quickly with a good solicitor, down in the valley below us there is a house that the english buyer was told the same about. That was 7 years ago, and now he knows he will NEVER get one, so he has a generator because Iberdrola wont connect him without the certificate.

Go and find another house that has the paperork done, or refuse to hand over any money until the cedula is in place, would be my advice

Yes it is the same thing. Ours is a Licencia de Primera Ocupacion.

Do not pay anything until an independent lawyer appointed by you has OK'd all the paperwork, especially including the bit that says it is legal as a dwelling.

Then pay it to the solicitor, not the Estate Agent.

If you are buying in Tarragona, these solicitors may help you. I do not know them, but they have an office in London and a UK and Spain qualified solicitor.
