anybody bought a new flat in or near denia

Default anybody bought a new flat in or near denia

can anybody shed some light on this please.ive been told that all new builds in denia dont get the licencia de primera ocupación for about three years.in theory this means that you might not have electric or water supplies.ive never read about it being a problem but am reluctant to buy a property if there is some doubt about the paperwork.my solicitor tells me its normal in denia and las marinas.

You are looking at mega trouble in the future no matter what your Solicitor says!!! Is he tied in with the Estate Agents

All true. Been there, done that - now have the licence.

Walk away and buy a legal one.

the solicitor isnt connected in any way.

montgomail,did you buy without the licence and then it was issued later? and without problems?

jdr,they are telling me that everything is legal,its just that in denia there is no plan urbanistic so everything is a mess and its normal practice.

How can they sell you a house that is not been classed as fit for habitation ?
What happens if they don`t give you the licence ?
You end up with a house that is not legally useable.
Also it should not be lived in until it has the licence, you could get a nasty surprise if you burn it down or something similar by accident.

True, although there are people around here who have been living in houses for 8 years without a cedula

Us too ... although we know of others less fortunate, who have not received their cedula after 6 years of waiting ...

All I can tell you is that in our office we would not let a person proceed without a habitation licence. If the client insists we ensure they sign a disclaimer saying they are proceeding against our advice. I have no personal knowledge of Denia though. There is the possibility though (and this happens in the Costa Blanca South) that you move in on builders electricity and water they go bust and the development have to pay their outstanding bills before you can contract with the relevant authorities but obviously a couple of posters have had no trouble themselves in Denia. At the end of the day you must decide what you think is best for you.

On builders supply for two and a half years. Wasn't a problem at all, but potentially it could have been.

I was advised by my solicitor that getting the licence of first occupation was a mere formality and it was ok to sign without it. In theory, he was right. All it takes is a visit from the town hall to check that the building has been built to plan. However, by the time the town hall had cleared the backlog to inspect our place, some apartment owners has glazed in their terraces to create an extra room. They refused to issue the certificate until the glazing was removed. The owners refused to remove the glazing. And so it went on for two and a half years.

We were also on Builders Supply for a couple of years, and Montgomail's experience mirrors ours ... and that of some of our neighbours!
