Foreign Spouse vs. Fiancee Visas Philippines
I'd appreciate any advice you might give. I have a fiancée in Manila,
Philippines. We are hearing conflicting things about the fastest way to
bring her here to the US. I am planning my trip to Manila in June. Would it
be better to marry her there during my visit, and then apply to the INS for
a Foreign Spouse Visa - or simply apply for a Fiancée Visa with the INS once
I've returned home?
Her friends there in Manila say the process happens more quickly going the
Fiancée Visa route, yet the INS website gives the impression that it is
easier and faster to bring her home under the Foreign Spouse visa.

hi there! from my experience...i got married in manila in August 2001 and filed for Family Petition (I-130) in Sept 2002 and K3 visa (I129f) in Sept 2002. Got approval for K3 I129F petition in Jan 2003 and now my husband was not approved because we gave the wrong affidavit of support forms.....my opinion would be go for the FIANCEE visa if you want her to be with you much sooner....but remember you still have other processes do go thru once she arrives in the USA....but with the I-130, it will take a longer wait and seperation but not much processes to go thru once she arrives in the USA...hope this helps

Hi All!
The fiancé visa is the fastest, with the K-3 coming in second and spouse visa
brining up the rear. Now I wouldn't get married in the Philippines, since you
have to go to the U.S. embassy and get an affidavit giving you permission and I
believe you then need to wait 15 or 16 days to get married. Then the marriage
info has to submitted to the NSO and have them issue a marriage certificate.
The less dealing you have with the NSO the better.
Now if the woman or her family insist that she get married there, then do the
K-3. The only advantage I see to the spouse visa is you enter as permanent
resident and don't need to file for AOS, but I didn't find filing for the AOS
that hard.
Here is a word of advise. Get her birth certificate from the NSO before you do
anything (order 2 or 3 copies). The NSO is notorious for getting names and
dates of birth wrong on BCs, so it maybe easier to go with any mistakes on the
BC from the beginning than get in the middle of the process and try to have them
corrected.

Joe, Fiancee is the fastest because you only deal with one route the 1noa and
2noa. K3 you have to recieved your 1noa before you can apply I-129f for k3.

A Freudian slip? INS and Fiancé/Spouse visas are continually "brining up"
everyone's rear. Really chaps my cheeks!
