I do remember that - but I'm afraid I don't remember where a link is.

In reference to previous posts, VAWA etc. - what I am wondering - where does the OP really want to live? Does he even want to stay here? I had inpression he would prefer to return home (but perhaps I am mistaken).

Which is why I said this in my response to him re the VAWA.

Your wife married you and refused to help make you legal in all these years. That is emotional and mental abuse. Go to the USCIS website and look up how to file a self-petition for residency through this Act. There are documents you will need, i.e. her birth certificate (at least her date of birth), your marriage certificate, any proof that you lived together all these years, etc.

Good luck.

I didn't mean any criticism - I was simply wondering if he might come back and clarify if he'd like to stay or go - and perhaps we could better help him.

Sorry if that came out wrong.

I honestly can not see a future for myself here now, no job, no money, no where to live long term and on top of all this i am still here illegaly.
Which is why i feel i am left with no alternative but to return to the UK.

I do realise that a ten year ban would hang over should i choose to go, but i have left the country once before and got back in without any problems at all, yes i was nervous walking up to customs but they stamped me through and have a a nice day was all i got.

I am going to look into some of the suggestions you guys have put up so thank you all very much and of course if anyone has any other info it is gratefully received.

Oh dear---are you saying that since you came here as a visitor to marry someone (did you marry?), you left, having overstayed the 90 day admission, and returned? As a visitor? Did you fillin the green form (I-94W)? What did you tell them was the purpose of your 'visit'?

You should assume that you aare not likely to be so lucky again.

I take it the return portion ofthe ticket has expired?

Lucky? The damage is done isn't it? I'll have to go refresh myself with the I-94W questions.

I took it that he used the VWP when not entitled.

Now it would be a 10 year ban and no VWP ever.

But he doesn't want to stay - in fact is asking about how to get deported, so what's the problem?

However if he wants to stay or to return at some point it is probably an issue.

Does lying on the VWP get you a lifetime ban? I take it he had to check 'no' to the question about 'have you ever overstayed a visa', which constitutes lying.

Unless perhaps he was just here on the visa waiver - and thus didn't overstay a "visa"...

I don't know personally.

He has a life time ban from using the VWP, not I think from getting a B. He could theoretically get a waiver for the ban, theoretically.

Is it possible to hand yourself in for deportation?

I will give you the background on this story.

I am a British citizen and came to the US about 4 years ago on a temporary visitors visa and married an American citizen, Our plan was to marry and register paperwork for me to become legal here.
Well after 4 years of me bugging and moaning at her to help me get the paperwork filled out, i have stopped trying.
A couple months back i found out she was cheating on me with another guy, I don't know why but i forgave her and said we can make it work, well about a week back i found out she was now seeing ANOTHER guy.
So that was that for me, i told her i was leaving and going back to the UK as soon as i could, well the problem is i have absolutely no money as i got fired from my job after she called them and told them i was stealing from there (lies).
So basically i have no money to pay for my flight home and i don't know what i should do or what the procedure is now.

Do i have to hand my self in and go to jail before i get deported or ????? just dont know.

Please help
Contact your nearest British Consulate to discuss the options available to you. Whilst the deportation process may sound easy, it can result in a few months behind bars so you are well advised to seek other ways of returning to the UK. Whilst the British Consulate doesn't have an emergency fund to get you home, in extreme circumstances we will provide you with a loan to get you back. You will have to repay it, and you won't get another British passport until you do.

Hope this helps.

Dean
