Hello again, BIP:

A close friend is going through the PAP/JR process on this topic of dual 4C/4G and 4L eligibility and we wanted to see if we could add anything that might be of help to others....

Hi again, BritInParis and others:

This has happened to a friend as well today and we are almost certainly going to do a strong PAP/reconsideration letter.

Re: 4L and s12(6) BNA 1948 / s11(3)(b) BNA 1981

Re: 4L and s12(6) BNA 1948 / s11(3)(b) BNA 1981

Thanks for the clarification on PMs, Chris. My other posts were not about this situation.

I saw you had made some edits to your reply: in reference to the first version of your post, "kidnapping"...

Re: 4L and s12(6) BNA 1948 / s11(3)(b) BNA 1981

Quite a few from the CUKC citizen who suffered historical legislative unfairness, but we have enough records from the British Library to show descent (per the immigration attorney).

Re: 4L and s12(6) BNA 1948 / s11(3)(b) BNA 1981

Hi there. That is not correct. I had an ancestor who, in 1962:

was a Commonwealth citizen
knew they were descended from an ancestor born in the United Kingdom in their male and female line, and...

Re: 4L and s12(6) BNA 1948 / s11(3)(b) BNA 1981

Also to add, for the avoidance of doubt, that we are certain there was intent around 1962 (and prior), we are just unsure how to "prove" this intent other than the fact that they subsequently did...

Hello jmin, BritInParis, and everyone,

I am trying to understand how to properly submit a 4L application for a former British subject (born 1930s in an s1(3) BNA 1948 country) and daughter (born...

Re: CUKC or British Subject without Citizenship?

pallykin, immigration attorneys do not simply blindly apply Fransman or other texts. They make arguments based on the totality of facts and circumstances.
A British subject child who has lived...

Re: CUKC or British Subject without Citizenship?

Yes, and I believe this is the safest route forward for complex claims.

If this is important to you, and it sounds like it is, I would focus on finding the correct professional advisor instead of...

pallykin, I believe our situations are sufficiently similar. I will let you know via private message if we make any headway. Please give us a few weeks on this. Per the Home Office, "only the courts...

Re: CUKC or British Subject without Citizenship?

jmin, I admire and respect all the help you provide on this forum. However, I disagree with your logic. You are saying that no British subject had the Right of Abode prior to 1948 unless they were...

Re: CUKC or British Subject without Citizenship?

Hi jmin! I was applying the logic to pallykin's case. Per his original post, his great-grandfather and grandfather were born in India, as British subjects.

Naturalization between 1870 and at least...
